The temporary residence Partner (Provisional) visa (subclass 309) visa enables an offshore de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia. The subclass 309 visa application includes an application for the permanent residence Partner (Migrant) visa (subclass 100).
Once the subclass 309 visa is granted, you can:
- Live, work and study in Australia while your subclass 100 visa is processed
- Travel to and from Australia while your visa is valid
- Attend free English language classes provided by the Adult Migrant English Program, if eligible
- Enrol in Australia’s public Medicare healthcare system
Once the subclass 100 visa is granted, you can:
- Stay in Australia permanently with unlimited work and study rights
- Sponsor relatives to visit Australia
- Travel to and from Australia for 5 years
- Become an Australian citizen if eligible
